Terms of Service

These Terms of Service ("Terms") govern your access to and use of Schedule Sizzle (the "Service"), operated by Chef Tony's Fresh Seafood, based in Rockville, Maryland, USA ("we", "us", "Schedule Sizzle"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old and have the authority to enter into a contract on behalf of the business you register. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@schedulesizzle.com if you suspect unauthorized access.

One restaurant per Account holder, except for the Enterprise plan which supports multiple locations under a single account.

2. The Service

Schedule Sizzle provides scheduling software for restaurants โ€” drag-and-drop shift planning, labor cost tracking, schedule publishing to staff, time-off and shift-swap requests, and related features. We may add, modify, or remove features at any time. We will give Account holders reasonable notice (via email or in-app) before removing a feature you actively rely on.

3. Trial, plans, and payment

$1 trial

New Account holders may pay a one-time $1 fee to activate a 14-day trial. The trial gives you full access to the Starter plan's features. The $1 is non-refundable.

Subscription plans

After the trial, you may select a paid plan: Starter, Growth, or Enterprise. Plans are billed monthly in advance via Stripe. Pricing on our pricing page is current at the time of subscription. Plan limits (staff cap) are enforced automatically.

Renewals

Subscriptions auto-renew each month unless cancelled. You can cancel anytime from the Pricing tab in the app or by contacting support@schedulesizzle.com. Cancellation takes effect at the end of the current billing period.

Refunds

We do not provide refunds for partial months. If we suspend or terminate the Service due to a fault on our end, we will issue a pro-rated refund for the unused portion of your current billing period.

Failed payments

If a charge fails, we will retry and email you. If payment is not made within 7 days of the original charge, we may suspend or downgrade your account until payment is received.

You own the data you put into Schedule Sizzle (staff records, schedules, sales figures). You grant us a limited license to host, transmit, display, and process that data for the purpose of operating the Service for you.

You are responsible for ensuring you have the legal right to enter staff information (including any consent required from your employees under your local labor laws). Our Privacy Policy describes how we handle this data.

You can export your data at any time from the app, or by contacting support. After cancellation, we retain your data for up to 90 days so you can reactivate; after that, we delete or anonymize it.

6. Service availability

We aim for high uptime but do not guarantee uninterrupted service. We may perform maintenance, deploy updates, or experience outages from upstream providers (Supabase, Netlify, Stripe). We are not liable for downtime caused by third-party services or events outside our reasonable control.

You may cancel your account at any time. We may suspend or terminate accounts that:

On termination, your access ends, and after the 90-day retention window your data is deleted.

8. Intellectual property

Schedule Sizzle, including its software, design, branding, and content, is owned by us or our licensors. These Terms do not transfer any ownership to you. You may not use our trademarks or branding without written permission.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOU USE THE SERVICE AT YOUR OWN RISK.

Schedule Sizzle is a tool to help you manage your schedule. It is not a substitute for legal, accounting, or HR advice. You are responsible for ensuring your scheduling practices comply with applicable labor laws (overtime, breaks, predictive scheduling, etc.).

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF WE WERE ADVISED OF THE POSSIBILITY.

11. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, or damages (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights โ€” including claims by your staff related to information you entered.

12. Governing law and disputes

These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Montgomery County, Maryland, and you consent to that jurisdiction. If any part of these Terms is found unenforceable, the rest remains in effect.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify Account holders by email and update the "Last updated" date above. Continued use of the Service after a change means you accept the revised Terms.
